Terms of Service

These Terms of Service set out the rules under which Igor Bily, operating under the Lokal360.pl brand (the "Provider"), delivers services to clients ordering through the lokal360.pl website and via direct contact.

1. General provisions

  • Provider: Igor Bily, operating under the Lokal360.pl brand.
  • Client: a business or individual who enters into a service agreement with the Provider.
  • Services: 360° virtual tours, websites, booking and payment systems, photography, SEO, and related services offered by the Provider.
  • Agreement: the arrangement between the Provider and the Client for the performance of selected services.

2. Scope and delivery of services

The Provider delivers digital and creative services for local businesses and private individuals. The exact scope, timeline, and price of each service are agreed individually and confirmed in a quote or in arrangements preceding the start of work.

The Provider operates solo, at an agency level. Selected work (e.g. part of the photography services) may be carried out with the support of cooperating contractors, while the Provider remains responsible for the quality of delivery.

3. Formation of the agreement and placing orders

Contacting the Provider (form, phone, email) constitutes an inquiry, not an order. The agreement is formed once both parties confirm the scope of work, price, and timeline — in writing, by email, or in another agreed form.

The start of work may be conditional on an advance payment and on the Client delivering the materials required to perform the service (content, logo, photos, access credentials).

4. Prices and payments

  • Prices are stated in Polish zloty (PLN). Whether a price is net or gross is specified in the quote.
  • Settlement may include an advance payment and a final payment upon completion, as agreed.
  • Recurring services (e.g. website maintenance, hosting, domain) are billed in agreed billing periods.
  • Payment is made by bank transfer to the Provider's account based on an invoice or other accounting document.

5. Delivery and timelines

Delivery timelines are agreed individually and counted from the moment the Client delivers the full set of materials and any advance payment is credited. Delays on the Client's side (missing materials, lack of approval, no response) may extend the delivery timeline accordingly.

The standard response time to Client messages is up to 24 hours on business days.

6. Copyright and licensing

Until full payment is settled, the economic copyright and licenses to the completed works remain with the Provider. After payment, the Client obtains the right to use the ordered work within the scope arising from the purpose of the agreement.

The Provider retains the right to present completed projects in its portfolio and promotional materials, unless the parties agree otherwise.

7. Hosting, domains and maintenance

Hosting, domain registration, and website maintenance are provided on a subscription basis, in annual or other agreed cycles. Failure to pay for a subsequent period may result in suspension of the service or expiry of the domain. The Provider is not liable for the consequences of failing to pay for recurring services on time.

8. Client obligations

  • Providing true, complete, and lawful materials (content, photos, trademarks).
  • Holding the rights to the materials handed over to the Provider.
  • Timely cooperation on approvals and settlement of payments.

9. Complaints

Complaints regarding delivered services should be submitted to mail@lokal360.pl. The submission should include the Client's details, a description of the objections, and the expected resolution. The Provider considers complaints within 14 days of receipt.

10. Right of withdrawal (consumers)

A Client who is a consumer has the right to withdraw from a distance agreement within 14 days, under the terms set out in the Polish Consumer Rights Act. The right of withdrawal does not apply, among others, to services fully performed with the consumer's explicit consent before the withdrawal period expires, and to digital content and services prepared to individual order.

11. Liability

The Provider exercises due diligence in delivering services. The Provider is not liable for interruptions in third-party services (e.g. Google, hosting operators, payment gateways) or for the consequences of the Client's acts or omissions. The Provider's liability for non-performance or improper performance of the agreement is limited to the amount of the fee for the given service, unless mandatory law provides otherwise.

12. Personal data protection

The rules for processing personal data are described in the Privacy Policy.

13. Final provisions

Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. The Provider reserves the right to amend these Terms; material changes will be announced by updating the date at the top of the document. Agreements concluded before an amendment are governed by the Terms in force on the date of conclusion.
